Statement of Policy

Newport World Resorts (“NWR”) fully respects, values, and protects data privacy rights, and ensures that all Personal Data collected from employees, guests, patrons, suppliers and partners, are processed in accordance with the general principles of transparency, legitimate purpose, and proportionality. 

Privacy Notice

By applying for NWR membership and/or availing of NWR services, you acknowledge and affirm that the owner and operator of NWR, including its parent company, affiliates, subsidiaries, and related companies, as well as their respective officers, directors, shareholders, employees, agents, and other parties with which they do business (hereinafter collectively referred to as the “Company”), may collect, use, process and/or disclose your Personal Data as disclosed by you in any activity related to the Company, including registration, participation, and enjoyment of any product, service, event, program, privilege, benefit or promotion of the Company. Processing of Personal Data may include but is not limited to recording, listing, systematization, accumulation, storage, updating, extraction, transfer, anonymization, blocking, deletion, destruction, whether through electronic means or otherwise.

Generally, NWR does not share collected personal data to other parties. However, in order to comply with legal or regulatory obligations, provide products and services, and/or complete transactions consistent with purposes declared in the Privacy Policy, NWR may share your Personal Data to other parties. The use or disclosure of your personal data will only be performed when it is reasonably necessary and/or required, and authorized under relevant laws and regulations. 

Please note that minors (persons under the age of 18 years) are not eligible to use our services unsupervised and we ask that children do not submit any information to us. If you are under the age of 18 years, you can use this website, our mobile app and other services only in conjunction with and under the supervision of your parent or legal guardian. Further, persons under the age of 21 years are prohibited from entering and playing in NWR’s gaming areas.  

Personal Data Collected

Various forms for registration, reservation, purchases, inquiries and surveys may request that you give us contact information (such as your name, mobile number, mailing and/or e-mail address), demographic information (such as your age, gender and nationality), and profile data (such as your preferences in products and services). Information submitted at the time of registration or submission may be used to provide products and services and/or marketing and promotional purposes by NWR and its subsidiaries, and may be shared with our promotional partners. Personal Data is never sold or leased to any third parties.           

When subscribing to our newsletter, a visitor needs to provide the following mandatory information: Salutation, First Name, Last Name, Email Address, Mobile Number, Government ID, Gender, Date of Birth, Place of Issue and Country.

Participation in activities, transactions and/or offerings is on a voluntary basis, which allows the data subject to decide whether to disclose any Personal Data.

We may also collect information about you from third parties who are legally allowed to share the same to us for legitimate purposes in order to provide you with our products and services.   

Basis, Use and Purpose for Processing of Personal Data

NWR collects and processes Personal Data for the following purposes:

  1. Compliance  with legal and regulatory requirements;
  2. To provide information about the Company and what we are doing;
  3. To inform you of NWR’s products, services, events, activities, loyalty and rewards offerings, exclusive invites, benefits, surveys, and other direct marketing advertisements based on your interest and preference as may have been provided or made known to us, from which you can unsubscribe at anytime;
  4. To facilitate the delivery of NWR’s products and services;
  5. Quality monitoring of products and services;
  6. To facilitate interactions through various media and forms of communications and respond to specific complaints, inquiries, requests and/or concerns;
  7. Survey, statistics and data analytics to optimize your experience at NWR and improve our business and operational efficiency; and
  8. To comply with a legal obligation to which the Company is subject and/or comply with the requirements of public order and safety.

Certain non-personal information is recorded by the standard operation of NWR’s Internet servers. Information such as the type of browser being used, its operating system, and your IP address is gathered in order to enhance your online experience.

If the law so permits, NWR may disclose user information in special cases when we have reasons to believe that disclosing this information is necessary to identify, contact or bring legal action against an individual or entity who/that may be causing injury to or interference (either intentionally or unintentionally) with NWR's rights or property, other NWR users, or anyone else that could be harmed by such activities.   

Security

Security of Personal Data is extremely important to us. Reasonable measures are in place to ensure that the Personal Data collected and processed are accurate and complete based on the information submitted to us, and adequate physical, technical, and organizational security measures are in place to protect the confidentiality, integrity, and availability of Personal Data. However, this does not guarantee absolute protection against certain risks involving the processing of Personal Data, such as when systems are exposed to targeted cyberattacks, malware, ransomware, and computer viruses or when manual records are accessed without authority.

Further, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect your Personal Data, NWR cannot ensure or warrant the security of any information you transmit to us or from our online products or services, and you do so at your own risk. Once we receive your transmission, we exert our best effort to ensure its security on our systems.   

Use of Cookies and IP Addresses

Cookies are pieces of information that a website transfers to an individual's computer hard drive for record keeping purposes. Cookies make using our Site easier by, among other things, saving your passwords and preferences for you. These cookies are restricted for use only on the Site, and do not transfer any Personal Data to any other party. Most browsers are initially set up to accept cookies; however, you can reset your browser to refuse all cookies or indicate when a cookie is being sent. (Note: you will need to consult the help area of your browser application for instructions.) If you choose to disable your cookies setting or refuse to accept a cookie, some parts of NWR's sites will not function properly or may be considerably slower.

An IP address is a number that is automatically assigned to your computer by your Internet provider whenever you're surfing the Web. When you request pages from NWR, our servers log your IP address. NWR collects IP addresses for the purposes of system administration, to report aggregate information to our advertisers, and to audit the use of our Site. We do not link IP addresses to anything personally identifiable, which means that your session will be logged, but you are anonymous to us. We may use your IP addresses in cooperation with your Internet provider to identify you if we feel it is necessary to enforce compliance with the law and our Terms and Conditions or to protect our service, sites, customers, or others.   

Information Tracking and Usage

NWR tracks and gathers information on this website that helps us to identify our visitors’ needs related to our website and our services. NWR is the sole owner of the information tracked and gathered on this website. We will never share, sell, or rent this information unless explicitly stated in this policy or ordered by a court of law.   

Other Communications

Unless otherwise provided herein, any other communications or materials you transmit to NWR by electronic mail or otherwise will be treated as non-confidential and non-proprietary. Anything you transmit or post may be used by NWR or its affiliates for any purpose, including, but not limited to, reproduction, disclosure, transmission, publication, broadcast and posting. Furthermore, NWR is free to use any ideas, concepts, know-how, or techniques contained in any communication you send to the Site for any purpose whatsoever including, but not limited to, developing, manufacturing and marketing of products/ services using such information.   

Data Retention

Unless a specific law requires a longer retention period or storage is required or necessary for business reasons, the maximum retention period of personal data gathered shall be 10 years from the 15th of April following the year of:

  • completion of the last transaction in the case of NWR members/guests/patrons; and
  • separation from employment, completion of contract or last engagement in the case of employees, consultants, artists, service providers and/or other contracting parties.

Unless we receive a request from the Data Subject that his/her Personal Data be deleted from our systems, database and/or hard copies within reasonable time and subject to limitations stated in relevant laws and regulations, collected Personal data are stored in secured facilities and are retained in accordance with the above parameters. Deleted Personal Data will no longer be searchable or included in anonymous searches and will be completely removed from all storage locations.   

Disposal And Destruction

When processing and/or storage of Personal Data is no longer required or necessary for business reasons, physical records shall be disposed of through shredding, while digital files shall be deleted. In all instances, our manner of disposal shall ensure that the personal information shall no longer be retrieved, processed, or accessed by unauthorized persons.   

Rights of a Data Subject

Data subjects have the right to be informed regarding the processing of Personal Data and withdraw consent that was previously granted in relation thereto or object to processing of Personal Data. Further, data subjects may be entitled to request the following in relation to their own Personal Data:

  1. Access to Personal Data by submitting the Personal Data Access Request Form; 
  2. Rectification of inaccurate or incomplete Personal Data by submitting the Personal Data Rectification Request Form;
  3. Erasure or blocking of Personal Data whenever warranted by submitting the Personal Data Erasure Request Form;
